When you use our mobile application, as the case may be (the "App") and more generally, use any of our services (the "Services", which include the App), we appreciate that you are trusting us with your personal information. We take your privacy very seriously. In this privacy notice, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy notice that you do not agree with, please discontinue use of our Services immediately.

This privacy notice applies to all information collected through our Services (which, as described above, includes our App), as well as any related services, sales, marketing or events.

Please read this privacy notice carefully as it will help you understand what we do with the information that we collect.

1. What information do we collect?

We collect personal information that you voluntarily provide to us when you register on the App, express an interest in obtaining information about us or our products and Services, when you participate in activities on the App (such as by booking sessions, profile updating or registration) or otherwise when you contact us.

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity data:

    Your name, title, address, telephone/mobile number, email address, date of birth and age, and gender;

  • Financial and payment Data:

    Bank account and payment card details; This includes your payment method, and encrypted, pseudonymized credit card information. We need this information to initiate your payments and assign them to the sessions you have placed. We also need this data to store your payment information for future session booking (if you give us your consent to do so).

    Details and records about payments to and from you, including details of products and services that you have purchased from us;

  • Technical data:

    Internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website;

  • Profile data:

    This includes your username and password, home or business addresses, location, purchases or bookings made by you, preferences, feedback and survey responses;

  • Location data:

    We collect information data such as information about your device's location, which can be either precise or imprecise. How much information we collect depends on the type of settings of the device you use to access the App. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Locations settings on your device. Note however, if you choose to opt out, you may not be able to use certain aspects of the Services.

  • Log data:

    We want to inform you that whenever you use our Service, in a case of an error in the app we collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as such as your Android ID, Advertising ID, IMEI, BSSID, MAC address, Device Name, Operation System version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

  • Device information and access data:This includes your device ID, device identification, operating system and corresponding version, time of access, configuration settings, and your IP address.
  • Usage data:information about how you use our website, mobile apps, products and services; and
  • Marketing and Communications data:your preferences in receiving marketing from us and our third party partners, and your communication preferences.

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with our services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

3. How is your personal data collected?

We process your personal data only in accordance with relevant data protection laws. We pay particular attention to the fact that all principles for the processing of personal data are taken into account. Therefore, we only process your data if this is lawful, and you can reasonably expect it to be processed.

We use different methods to collect data from and about you including thorough:

    1. Direct interactions:
      1. apply for or purchase our products or services;
      2. download and use nuvad's mobile apps
      3. complete any forms or questionnaires;
      4. subscribe to our publications or marketing; or
      5. give us feedback or contact us.
    2. Automated technologies and interactions:
      1. As you interact with our website and apps, we will automatically collect Technical Data and Usage Data about your devices, browsing actions and patterns. We collect this personal data by using cookies and other similar technologies. Please see our Cookie Policy for further details.
      2. Nuvad may supplement the information that you provide to us, or which we are given, with information that we receive or obtain from other sources, such as from our professional practioners, partners, and service providers of nuvad, third parties with whom we interact, and publicly available sources.

4. Purposes for which we use your personal data

We have set out below, a description of all the ways we plan to use your personal data and which legal bases we rely on to do so. We have also identified what our legitimate interests are, where appropriate.

Please note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. Please contact us if you need further details about the specific legal ground we are relying on to process your personal data where more than one ground has been set out, for the purposes below:

    1. We use the information we collect or receive:
      1. To facilitate account creation and logon process. If you choose to link your account with us to a third-party account (such as your Google or Facebook account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process for the performance of the contract.
      2. To post testimonials. We post testimonials on our App that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and the consent of the testimonial. If you wish to update, or delete your testimonial, please email us atinfo@nuvad.appand be sure to include your name, testimonial location, and contact information.
      3. Request feedback. We may use your information to request feedback and to contact you about your use of our App.
      4. To enable user-to-user communications.We may use your information in order to enable user-to-user communications with each user's consent.
      5. To manage user accounts.We may use your information for the purposes of managing our account and keeping it in working order.
      6. Fulfill and manage your sessions. We may use your information to fulfill and manage your sessions, payments and refunds made through the App.
      7. To respond to user inquiries/offer support to users.We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our services.

5. Disclosure of your personal data

We may share your personal data with the third parties set out below, for the purposes set out in Section 4 (Purposes for which we use your personal data) above:

    1. where you are purchasing and products or services from us, we may share your personal data with or practioners and service providers (e.g. massage therapists, beauticians, nail/hair salons, barber shops and spas) where this is necessary in order to provide the products or services to you. This is so they can provide the products or services requested, communicate with you for this purpose, and provide you with feedback and updates on the provision of the products and services (e.g. how you are progressing with your sessions, and what further actions require to be taken);
    2. To post testimonials. We post testimonials on our App that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and the consent of the testimonial. If you wish to update, or delete your testimonial, please email us atinfo@nuvad.appand be sure to include your name, testimonial location, and contact information.
    3. vendors who will process your personal data on our behalf and under our written instructions to carry out their services during the course of our business, such as IT service providers, financial institutions, customer relationship management vendors and other cloud-based solutions providers that are used by us in conducting our business. We contract with such vendors to ensure that they only process your personal data under our instructions and ensure the security and confidentiality of your personal data by implementing the appropriate technical and organisational measures for such processing;
    4. our professional advisors (e.g. lawyers and accountants);
    5. third parties to whom we are required to transfer personal data by law, such as law enforcement bodies, governmental and regulatory bodies, the courts and other competent authorities that may request personal data in connection with any inquiry, court order, or other legal or regulatory procedures which we would need to comply with. We may also share personal data to establish or protect our legal rights, property or safety, or the rights, property or safety of others, or to defend against legal claims; and
    6. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

6. Data security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality. ‍

7. Data retention

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect of our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

In some circumstances you can ask us to delete your data. To delete your personal information, please submit a request form by clicking here. We will respond to your request within 30 days.

8. Your legal rights

Under data protection law, you have certain rights in relation to your personal data:

    1. Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
    2. Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
    3. Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with applicable law. Please note however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
    4. Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
    5. Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:
      1. if you want us to establish the data's accuracy;
      2. where our use of the data is unlawful but you don’t want us to erase it;
      3. where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or
      4. you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
    6. Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
    7. Withdraw consent at any time where we are relying on consent (including explicit consent) to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data, or access someone else's personal data on their behalf (or to exercise any of the other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

9. Third-party links

This website and our mobile apps may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website or apps, we encourage you to read the privacy policy of every website you visit.

However, the last update date is given at the start of this Privacy Policy, and we encourage you to review this Privacy Policy periodically so you remain informed of how we use your personal data.
